These terms and conditions serve as the contract between the customer (“Client”) and Cosmic Sweets Dessert Emporium LLC (“Company”). By paying your invoice, or ordering from any of our partner platforms you agree to the following terms:

Terms & Conditions - the basics

PAYMENTS & CANCELLATIONS

• All sales are final. Full payment is required to secure and place your order.

• Non-Refundable Policy: All payments are non-refundable. At the sole discretion of Management, store credit may be issued for future use.

• Requests: Any request for store credit must be submitted in writing to support@cosmicsweetsdessertemporium.com. The Company will review and provide a determination via email within 14 days.

CHANGES TO ORDERS

• Deadline: Changes to size, flavor, or style must be requested at least 48 hours prior to the scheduled pick-up/delivery date. Changes requested after this window are not guaranteed and may incur additional rush fees.

• Format: All changes must be submitted via email. Requests made via social media, text, or phone will not be honored or considered binding.

• Substitutions: Seasonal items or specific ingredients may be subject to availability. The Company reserves the right to make comparable substitutions if necessary.

PICKUP, TRANSPORTATION & HANDLING

• Transfer of Liability: The Client is responsible for the product as soon as it leaves the Company’s premises.

• Visual Approval: Upon visual inspection and departure from our premises, the Client approves the product's appearance and waives any rights to a refund or credit based on style, design, or visual aesthetics.

• Arizona Heat & Handling: High temperatures can damage desserts (especially buttercream and chocolate). The Client is responsible for transporting products in a climate-controlled vehicle and storing them in a cool, dry place. The Company is not liable for damage caused by heat, improper transport, or poor handling after pickup.

RIGHTS & WAIVERS

• Photography: The Company reserves the right to take and use photos of any product for display, marketing, or promotion.

• Allergens: Products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. The Client is responsible for notifying guests/consumers. The Company is not liable for adverse allergic reactions.

• Force Majeure: In the event of a natural disaster, accident, or other situation outside the Company’s control (Force Majeure), this contract may be voided without penalty to the Company.

• Liability Limit: The Company’s total liability is limited to the amount paid for the goods and services. The Company will not be liable for any special, incidental, or consequential damages.

DISPUTES & GRIEVANCES

• Reporting: All grievances must be submitted in writing via email within 7 days of the date of service.

• Resolution: Parties will first attempt to resolve any dispute in good faith through direct negotiation.

• Governing Law & Jurisdiction: This agreement is governed by the laws of the State of Arizona. Any legal disputes that cannot be settled through negotiation shall be resolved in the small claims courts of Maricopa County, Arizona, or via a mutually agreed-upon local mediator in Surprise, AZ. This replaces any requirement for international arbitration.
